Identify a lawyer as needed
At each stage of implementation, new legal needs will emerge and it will be necessary to ensure the competence of the lawyer according to these needs. There are the inevitable: the immigration lawyer, for visas and the corporate lawyer, who deals with the statutes, the shareholders’ agreement and the first contracts of the company. It may be the same lawyer, a colleague in his office, or even another firm. Geographical competence will be decisive, since a lawyer registered at a bar of a US State is not intended to deal alone with cases concerning another State, except for federal matters (eg copyright, patents, trademarks, immigration), even if there are basic reflexes for certain problems (eg negotiation of commercial contracts). In this way, labor law issues are state-specific, and it will be necessary to recruit a lawyer from the state who will have to deal with these issues.
Select and recruit a lawyer
Once we have identified a lawyer for a given problem, either by word of mouth (friends, chamber of commerce, implementation consultant, incubators, lawyer in France ..), or after a search on the internet, the goal is to establish with him / her a relationship of trust. An important element in the preliminary discussion with the lawyer is not to give the impression that one goes fishing for information and extirpate the most information gratuitously. You will have at best only half-answers and you will not give the image of a serious customer.
